Dispute Resolution Policy

We want every customer to have a positive experience. This Dispute Resolution Policy describes the steps to take if you have a concern or a dispute with ABC Decorative Rugs. It is part of, and is governed by, our Terms of Use.
1. Talk to Us First
Most issues can be resolved quickly by contacting customer support. Please reach out before initiating any formal proceeding so we have the opportunity to address your concern.

- In your message, please include your order number (if applicable), a clear description of the issue, the resolution you are seeking, and your contact information.
2. Informal Resolution Period
We commit to acknowledging your message and to working in good faith to resolve the matter. Please allow at least thirty (30) days from your initial written notice for us to investigate and respond before pursuing further action. Many concerns — including order issues, returns, refunds, and shipping disputes — can be addressed during this period.
3. Governing Law and Venue
Disputes arising out of or relating to our website, products, or services are governed by the laws of the jurisdiction where we operate, as described in our Terms of Use. For orders and interactions associated with our California operations, the laws of the State of California apply, and exclusive venue lies with the state and federal courts located in California, except as otherwise required by mandatory consumer-protection law. For orders and interactions associated with our other U.S. operations or our Canadian operations, the laws of the applicable U.S. state or Canadian province apply.
4. Arbitration and Class Action Waiver (Where Permitted)
To the extent permitted by applicable law, you and we agree that any dispute that cannot be resolved informally shall be resolved through final and binding individual arbitration, rather than in court, with the following clarifications:
- Either party may bring an individual action in small-claims court if the dispute qualifies.
- Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or to prevent unauthorized use of the website.
- Disputes will be resolved on an individual basis. To the extent permitted by law, you and we waive the right to participate in a class action, class arbitration, or representative proceeding.
This arbitration provision does not apply where it is prohibited or restricted by mandatory consumer-protection or arbitration law applicable to your residence. Some jurisdictions, including parts of Canada, restrict the enforceability of pre-dispute arbitration clauses and class-action waivers in consumer contracts. Where such restrictions apply, the affected provisions are limited or do not apply, and the rest of this policy continues to apply.
5. Canadian Customers
For Canadian customers, nothing in this policy limits any rights you have under applicable consumer-protection legislation in your province or territory, or your right to bring a complaint to a relevant regulator. The Office of Consumer Affairs (Canada) and provincial consumer-protection offices can provide additional guidance.
6. California Customers
If you are a California resident, you may also reach the California Department of Consumer Affairs, Consumer Information Division, at 1625 North Market Boulevard, Sacramento, California 95834, or by telephone at (800) 952-5210, in accordance with California Civil Code Section 1789.3.
7. Limitation Period
Except where prohibited by law, any claim arising out of or relating to the website or your purchases must be filed within one (1) year after the cause of action accrues, or it is permanently barred.
8. Severability
If any portion of this Dispute Resolution Policy is held to be unenforceable, that portion will be severed and the remaining portions will continue in full force and effect.
9. Updates
We may update this policy from time to time. The “Last updated” date above reflects the most recent revision. Continued use of the website after changes constitutes acceptance of the revised policy.
